General conditions of limited manufacturer's warranty for ONDILO devices

Manufacturer's warranty

Legal warranties apply independently of the manufacturer's warranty. 

The ONDILO manufacturer's warranty is a commercial manufacturer's warranty offered by ONDILO to users who have acquired an ONDILO product for private use. 

It confers rights different from those available to the consumer under the law, including, but not limited to, those relating to non-conforming products or products with latent defects. 

ONDILO comes with a 1-year manufacturer's warranty.

The benefits conferred by ONDILO's manufacturer's warranty are in addition to, and do not replace, statutory rights.

What the manufacturer's warranty covers :

From the date of purchase by the end user, ONDILO warrants ONDILO brand products sold in their original packaging to be free from defects in materials and workmanship for a period of 1 year, provided they are used in accordance with the instructions for use and other technical specifications presented on the ondilo.com website.

What the manufacturer's warranty does not cover :

This manufacturer's warranty does not cover non-ONDILO hardware and software, even if sold or packaged with ONDILO hardware.

The manufacturer's warranty does not apply to the damage listed below:

a. Schäden, die durch eine Verwendung des Produkts verursacht wurden, die nicht den von ONDILO veröffentlichten Richtlinien entspricht, sei es im Benutzerhandbuch, in den technischen Daten oder in anderen Richtlinien (Beispiel: falsche Lagerungsbedingungen des Produkts oder die Nichtbeachtung der Kalibrierungs- und Wartungsanweisungen für die Sensoren), wie in den Allgemeinen Geschäftsbedingungen für die Verwendung von ONDILO-Geräten definiert.
b. Damage resulting from normal wear and tear or normal aging of the ONDILO product.
c. Cosmetic damage, including but not limited to scratches, scuffs or breakage of plastic components.
d. Damage caused by accident, misuse or abuse (e.g. water ingress due to incorrectly tightened sensors or cover).
e. Damage caused by use of a third-party component or product that does not meet the specifications of the ONDILO product (e.g. battery charger) as defined in the general conditions of use for ONDILO devices.
f. Damage caused by any intervention or modification carried out by anyone other than an ONDILO representative or an authorized service center (e.g. removing the product's closing and sealing screws).
g. Damage caused by dropping, impact or any other external cause, including damage due to sand or damp.
h. Electrical damage overvoltage due to use of non-original accessories (battery, charger, etc.)
i. Damage caused by use in water whose parameters do not comply with ONDILO operating instructions.

The manufacturer's warranty does not apply to defects, theft :

a. Mechanical failure (broken parts, damage resulting from a fall, etc.)
b. Failures resulting from rough handling or unauthorized use.
c. If information indicates that the product has been stolen or that the user cannot prove that he/she is the authorized user of the product (e.g. by presenting proof of purchase)

The manufacturer's warranty does not apply to the products listed below:

a. Products that have been opened, modified or repaired by unauthorized service centers
b. Products that have been exposed to moisture, steam, extreme thermal or environmental conditions, sudden changes in these conditions, corrosion, oxidation, contact with food or liquids, or the action of chemicals c. Products whose batteries have been charged with a charger other than those approved by ONDILO.
d. Products whose model, serial or IMEI number has been altered, erased, deleted or rendered illegible.
e. Products stored for more than 12 months at the professional's premises
f. ONDILO on-board software, ONDILO mobile application, ONDILO device data and settings
g. User manuals and any software supplied on separate information media.
h. Services provided by third parties, by unauthorized service centers or by the customer (such as installation, configuration or software downloads).

Finally, the warranty does not extend beyond the warranty period.

Important Restrictions

ONDILO may restrict warranty service to countries where ONDILO or its authorized dealers sell the device.

The consumer may request repair in a country other than the country of purchase. In this case, he will be required to comply with all applicable import and export laws and regulations, and will be liable for customs duties, VAT and other related taxes and charges.

After warranty service, your ONDILO product or a replacement product will be returned with the original configuration at the time of purchase, subject to applicable updates. Recovery and reinstallation of software, data and other information are not covered under this warranty.

ONDILO may install system software updates as part of the warranty service that will prevent the ONDILO product from reverting to an earlier version of the system software. Third-party applications that have been linked to the ONDILO product may not be compatible or may not function as a result of the system software update. Restoration of services and data in connection with such third-party applications are not covered under this warranty.

Limitation of Liability

a. Entire agreement: With the exception of the rights granted by the Consumer Protection Act, as specified at the beginning of this document, all warranties and other conditions not stipulated in this warranty document are, to the fullest extent permitted by law, excluded from the ONDILO manufacturer's warranty.
b. Data Release: ONDILO does not warrant, represent or promise that it will be able to repair or replace any ONDILO Product under this warranty without risk and/or loss of information and/or data stored on the ONDILO Product.
c. Limitation of liability: In all cases, ONDILO's liability is limited to the replacement or repair of defective parts without any compensation or damages being claimed for material or physical damage or other prejudice caused.

What Ondilo does in the event of a manufacturer's warranty

If, during the warranty period, you submit a claim to Ondilo under this manufacturer's warranty, Ondilo will, at its option

Repair the Ondilo Product using new or previously used original Ondilo parts that have been tested and meet Ondilo's functional requirements, or
Replace the Ondilo Product with a replacement product of the same model (or, with your consent, a product that has the same or substantially similar features as the original product: for example, a different model with the same features or the same model in a different color) that is new or consists of new and/or previously used original Ondilo parts and that has been tested and meets Ondilo's functional requirements, or

If a part or product is replaced, any replacement product will become your property and the replaced product will belong to Ondilo.

If the product is returned to the workshop and the diagnosis reveals that the instructions for use have not been followed, the purchaser may choose to

Decide to collect the product. Shipping costs will then be charged to the customer.
Validate a repair or replacement estimate (product or spare parts) proposed by Ondilo.

ONDILO manufacturer's warranty

For products purchased directly from the manufacturer ONDILO or from one of its authorized dealers, the procedure for any request to implement the ONDILO manufacturer's warranty is as follows. Correctly following the procedures requested by the assistance service is a sine qua none condition for warranty coverage.

a. Contact ONDILO Support (https://ondilo.com/en/support/contact-customer-service/)
b. Provide proof of purchase in the form of a receipt or invoice, clearly indicating the date and place of purchase (ONDILO or authorized dealer). NB: Warranty claims cannot be processed without proof of purchase.
c. Provide product serial number (SN or UUID)
d. A unique file number will be assigned to identify the buyer and the product concerned by the request.
e. ONDILO support will assist the purchaser. If the problem cannot be solved remotely and/or if a technical diagnosis is required to determine whether the defect falls within the scope of the manufacturer's warranty. The purchaser may be referred́ to an authorized ONDILO service center.
f. The consumer may be asked to answer questions in order to diagnose potential problems.
g. Each customer sends his defective device(s) by the carrier of his choice. In the case of an out-of-warranty unit, the unit will be returned at the customer's expense. In the case of a device under warranty, we will return the device at our expense. No material may be deposited with or collected from our Technical Service. Equipment always travels at the user's risk. It is the user's responsibility to pack the equipment appropriately when shipping it, and to check its condition on receipt. If necessary, reservations should be made with the carrier at the time of delivery.
h. Immobilization and deprivation of use of a device in the event of repair shall not give rise to compensation, nor to the loan of a device for the duration of the repair.

General

No dealer, employee or agent of ONDILO is authorized to make any modification, extension or addition to this warranty.

If any condition is deemed illegal or unenforceable by law, it will be excluded from the warranty, and the legality or enforceability of the remaining conditions will not be affected.

Jurisdiction

If you are a consumer acting as such, the competent court will be that of your domicile.
